1. Acceptance

By creating a Pictual account or using our services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use Pictual.

These Terms form a legally binding agreement between you and Pictual, operated from the Netherlands. Dutch law governs these Terms.

2. The service

Pictual is an online platform that allows photographers and other creative professionals ("Users") to upload photos and media, build visual client galleries, and share those galleries with their clients via a private link.

Pictual is currently in alpha. Features may change, and we may introduce, modify, or discontinue parts of the service at any time. We will do our best to notify registered users of significant changes.

3. Account requirements

To use Pictual you must:

One person may not maintain multiple active accounts. Accounts created by automated means (bots) are not permitted.

4. Plans and storage limits

Pictual offers a free plan and paid plans (Pro and Business). Each plan has its own storage limit for the combined size of all photos and media files in your account: Free 5 GB, Pro 50 GB, Business 500 GB.

If you exceed your storage limit, you will not be able to upload new files until you free up space by deleting projects or media items, or upgrade to a plan with more storage.

5. Billing and subscriptions

For Pro and Business, you can choose monthly or annual billing. Listed prices include 21% VAT. Paid subscriptions renew automatically at the end of each billing period until you cancel.

You can cancel your subscription at any time from your account settings. Cancelling stops future charges; you keep access to your plan's features until the end of your current, already-paid period. We don't offer refunds for the unused portion of a current period.

If a payment fails (for example, an expired card), we automatically retry it. If it keeps failing for more than 3 days past the due date, we move your account back to the free plan. Your content and galleries are kept and remain viewable — a failed payment never causes data loss.

We may change prices for future billing periods. Changes affecting an active subscription will be announced at least 30 days in advance; you can cancel free of charge before the new price takes effect.

Payments are processed securely by our payment provider, Mollie — Pictual does not store your card or bank details itself. By starting a paid subscription, you authorize Pictual to automatically charge the subscription amount to your chosen payment method at each renewal. Yearly billing gives a 10% discount compared to the monthly price, prepaid for the full period. All listed prices are in euros (€).

Right of withdrawal: as a consumer, you normally have a 14-day cooling-off period to withdraw from a distance purchase free of charge. Because our digital services (such as an immediately active Pro subscription or an instantly downloaded Memories photo/album) are delivered right after payment, checkout explicitly asks for your prior consent to start that delivery immediately \u2014 by giving it, you waive this right of withdrawal, as permitted by law (Art. 16(m) of Directive 2011/83/EU). Without that explicit consent, delivery will not start before the cooling-off period ends.

6. Acceptable use

You may use Pictual only for lawful purposes and in accordance with these Terms. You must not:

7. Your content and intellectual property

You own your photos. By uploading content to Pictual, you retain full ownership of your intellectual property. You grant Pictual a limited, non-exclusive, royalty-free licence to store, process, and serve your content solely for the purpose of providing the service to you.

You confirm that you have the right to upload and share any content you add to Pictual — including the right to photograph and share images of the people depicted. Pictual is not responsible for content uploaded by users.

Pictual's name, logo, and platform design are owned by Pictual and may not be used without our written permission.

8. Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

9. Availability and service changes

We aim to keep Pictual available 24/7 but cannot guarantee uninterrupted access. We may perform maintenance, updates, or emergency fixes at any time. We are not liable for losses caused by downtime or service interruptions.

We reserve the right to discontinue Pictual entirely. If this happens, we will give registered users at least 30 days' notice and a way to export or download their content.

10. Limitation of liability

To the fullest extent permitted by Dutch law, Pictual is not liable for:

Our total liability to you for any claim arising from use of the service shall not exceed the amount you have paid us in the 12 months preceding the claim (which, for free-plan users, is €0).

11. Termination

You may delete your account at any time by contacting us at info@pictual.nl. Upon deletion, your data will be permanently removed within 30 days.

We may suspend or terminate your account without notice if we believe you have violated these Terms, are using the service fraudulently, or are causing harm to other users or to Pictual.

12. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts of the Netherlands, unless mandatory consumer protection laws in your country of residence provide otherwise.

13. Changes to these Terms

We may update these Terms from time to time. We will notify registered users by email before material changes take effect. Continued use of Pictual after the effective date constitutes acceptance of the updated Terms.
